Bush domestic spying program to be tested in fed court in Detroit

For the first time in open court, the Bush administration will defend the constitutionality of a domestic spying program operated by the National Security Agency during a hearing today in U.S. District Court. "Federal appellate courts have previously held that it is not unreasonable for the president of the United States to conduct searches and seizure without a search warrant when his motive for the search or seizure is national security," said Henry Karlson, professor of law at the Indiana University School of Law-Indianapolis.
